1. Who we are and what these terms cover
The Numis House (“TNH”, “we”, “us”) operates an online marketplace, auction platform, forum, and community for collectors of world currencies — banknotes and coins from around the globe. The platform is operated by [Legal Entity Name], with its principal place of business in India.
These Terms of Service (“Terms”) form a binding agreement between you and TNH covering your access to and use of thenumishouse.com and any related applications and services (together, the “Platform”). Specific activities are governed by additional policies that form part of these Terms:
- Marketplace Terms — buying fixed-price items
- Auction & Bidding Terms — participating in auctions
- Vendor Terms — selling on the Platform as an approved vendor
- Returns & Refunds Policy, Shipping & Export Policy, Authenticity Guarantee
- Prohibited & Restricted Items Policy, Community Guidelines, AML & KYC Policy
- Privacy Policy and Cookie Policy
If a specific policy conflicts with these Terms, the specific policy prevails for that activity. By creating an account, browsing, buying, bidding, selling, or posting, you accept these Terms. If you do not agree, please do not use the Platform.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into contracts to buy, bid, or sell on the Platform. By registering you confirm that the information you provide is accurate and that you will keep it up to date.
You are responsible for all activity under your account and for keeping your credentials secure. Notify us immediately at support@thenumishouse.com if you suspect unauthorised use. We may suspend or terminate accounts that breach these Terms, provide false information, engage in fraudulent activity, or create risk for other users or for TNH.
One person may not maintain multiple accounts to circumvent bidding rules, suspensions, or purchase limits.
3. The nature of our marketplace
Items on the Platform are sold either by the TNH team directly (“TNH Direct”) or by independent third-party vendors approved by us (“Vendors”). Where an item is sold by a Vendor, the contract of sale is between you and that Vendor; TNH provides the platform, payment facilitation, and dispute-resolution framework, and applies its Authenticity Guarantee to every listing. The seller of each item is identified on the listing page.
Nothing on the Platform constitutes investment, tax, or financial advice. Collectible currencies fluctuate in value; past prices are no guarantee of future value. You buy and sell at your own judgement.
4. Legal compliance specific to numismatic goods
Numismatic material is subject to unusual and overlapping laws worldwide. By using the Platform you acknowledge and agree to the following:
- Cultural property and antiquities: many countries restrict the export, import, or trade of historic coins and notes. In particular, items classified as “antiquities” under India's Antiquities and Art Treasures Act, 1972 (which generally includes coins and similar objects over 100 years old that are of Indian origin and located in India) cannot be exported from India, and listings of such items are sold for domestic Indian delivery only, as flagged on the listing.
- Import rules: some destination countries restrict the import of ancient or cultural goods (for example, import restrictions implemented under the 1970 UNESCO Convention, the EU cultural goods import regulation (EU) 2019/880, and United States import restrictions under the Convention on Cultural Property Implementation Act). The buyer is responsible for confirming that an item may lawfully be imported into their country.
- Counterfeits and reproductions: the sale of counterfeit currency is illegal everywhere. Reproductions and replicas may only be listed where clearly and permanently marked as such (for example, marked “COPY” consistent with the United States Hobby Protection Act) and clearly described as reproductions.
- Current legal tender: trading in currently circulating legal tender at a premium may be restricted in some jurisdictions. TNH focuses on collectible, demonetised, and historic issues; sellers must comply with the rules applicable to any current-issue material.
- Sanctions: transactions must comply with applicable trade sanctions (including UN, EU, UK, and US OFAC regimes). We may decline, cancel, or reverse any transaction that we reasonably believe would breach sanctions law.
5. Pricing, currency, and payment
Prices are set in US dollars and may be displayed in other currencies for convenience using indicative exchange rates; the settlement amount and currency are stated at checkout. Payment is collected through our third-party payment providers. We do not store full card numbers on our servers.
Obvious pricing errors do not bind us or a Vendor: if an item is listed at a manifestly incorrect price, the affected order may be cancelled and refunded in full.
6. Your content
You retain ownership of content you post (forum posts, collection showcases, reviews, listing content if you are a Vendor). You grant TNH a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content for operating and promoting the Platform.
You must not post content that is unlawful, infringing, defamatory, deceptive, or that violates our Community Guidelines. We may remove content and restrict accounts at our discretion to keep the Platform safe and lawful.
If you believe content on the Platform infringes your intellectual property, email legal@thenumishouse.com with the URL, a description of the work infringed, your contact details, and a good-faith statement; we review and act on valid notices promptly.
7. Intellectual property of TNH
The Platform, including the TNH name, logos, seal, design, software, and databases, is owned by or licensed to TNH and protected by intellectual-property laws. You may not scrape, copy, frame, or create derivative works from the Platform except as permitted by law or with our written consent. Images of items remain the property of their photographers/owners and may not be reused without permission.
8. Disclaimers and limitation of liability
The Platform is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly set out in our Authenticity Guarantee and Returns & Refunds Policy.
To the maximum extent permitted by law, TNH's aggregate liability to you for any claim arising out of the Platform is limited to the greater of (a) the amount you paid to TNH in the 12 months before the event giving rise to the claim, or (b) INR 20,000 / USD 250. We are not liable for indirect, incidental, or consequential losses, or for loss of profit, data, or goodwill.
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, or your statutory rights as a consumer in your country of residence. If you are a consumer in the EU/UK or another jurisdiction with mandatory consumer protections, you keep the benefit of those protections.
9. Disputes between buyers and vendors
If a problem arises with a Vendor purchase, contact the Vendor through your order page first. If it is not resolved within 7 days, escalate to TNH support; we will review evidence from both sides and may, at our discretion, order a refund, return, or release of payment. Our decision under this internal process is binding on Vendors as a condition of selling on the Platform, and is without prejudice to your legal rights.
10. Changes, suspension, and termination
We may update the Platform and these Terms from time to time. For material changes we will give notice (for example by email or a site banner) at least 15 days before they take effect, except where changes are required by law or address safety or fraud. Continued use after the effective date constitutes acceptance.
You may close your account at any time. Sections that by their nature survive termination (including ownership, liability limits, and dispute terms) continue to apply. Open orders, auctions you are winning, and amounts owed survive account closure.
11. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any mandatory consumer-protection rules that give you the right to bring proceedings in your own country, courts at [Your City], India have exclusive jurisdiction over disputes arising from these Terms.
